When overseas mines and traders first quote to China, the opening questions are usually “what is the duty?” and “can we go through a free trade zone?” In practice, what actually strands cargo at the port is a product description that does not match the material, a wrong HS code, hazardous-element or radioactivity risk, suspicion of solid waste, and a contract that never allocated responsibility for return shipment and demurrage.
Three misconceptions worth clearing up first
Misconception 1 — every metal ore needs an automatic import licence. The 2026 catalogue of goods under automatic import licensing does not list common metal ores and their concentrates as a single blanket category. Whether a licence is required has to be checked item by item against that year's catalogue and the specific 10-digit customs commodity code — not carried over from old paperwork, and certainly not judged from the product name alone.
Misconception 2 — an SGS report guarantees clearance. A third-party assay helps with pricing and pre-shipment control, but it does not replace China customs' statutory inspection, risk monitoring or solid-waste determination. For copper concentrate, hazardous-element limits bear directly on admissibility; if the appearance, origin, processing route and composition of the cargo resemble tailings, smelter slag or other waste, it can still enter solid-waste screening or identification — “it contains metal” notwithstanding.
Misconception 3 — entering a free trade zone means duty-free import. Pilot free trade zones, comprehensive bonded zones, the Hainan Free Trade Port and free trade agreements are four different things. Bonded status usually means the tax is deferred until the goods leave the zone for the domestic market — not that the tax disappears. Whether goods can be blended, processed or re-exported also depends on the zone's functions, the company's qualifications, the customs supervision plan, and whether the cargo itself meets admission requirements.
Admissibility really comes down to four layers
Layer one: what the material actually is. Ore, concentrate, intermediates, smelter slag, tailings and metal-bearing waste may all get called “ore” in commercial talks, but they are entirely different things for customs classification and environmental regulation. Get the origin, the mining/processing or smelting route, the mineral phases, a full elemental analysis, moisture and particle size first — then discuss the HS code.
Layer two: whether it meets Chinese admission requirements. Statutory inspection conditions, hazardous-element limits, radioactivity, dangerous properties, inclusions and solid-waste risk all need checking together. The pre-shipment report should cover the payable elements in the contract and the safety and environmental items Chinese ports care about.
Layer three: whether the documents corroborate each other. Product name, quantity, lot, shipper and consignee across the contract, invoice, bill of lading, packing or weight list, certificate of origin, assay report and process description must form a closed loop. A complete document set is not the same as a truthful one; what matters is that the documents do not contradict each other.
Layer four: who carries it when something goes wrong. At a minimum the contract should set out the sampling method, the inspection body, the final settlement basis, what happens if hazardous elements or waste classification fail, demurrage, return-shipment costs, transfer of title, payment milestones and dispute resolution. Without those clauses, a cheap-looking cargo may simply be transferring port risk to the buyer.
Tax: zero duty is not zero tax
Many base-metal ores and concentrates attract low or zero duty, but the final position still has to be confirmed against the specific tariff line, the country of origin and that year's tariff schedule. For ordinary goods, import VAT in 2026 is generally charged at the 13% standard rate; specific exemptions exist for things like gold ore where the policy conditions are met, and a particular concession cannot be generalised to all mineral products.
For Southeast Asian sellers, the value of an FTA certificate of origin also has to be worked out case by case. If the MFN duty on a given mineral is already 0%, the certificate may not reduce duty at all — though it can still evidence origin, bring specific agreement rules into play, or satisfy compliance requirements from banks and customers. Tax, origin and regulatory conditions should each be verified separately.
What free trade zones really give you is optionality
As of August 2026 China has established 23 pilot free trade zones; the Manzhouli and Erenhot areas of the Inner Mongolia zone have further strengthened resource corridors towards Mongolia and Central Asia. For mineral products, though, the more direct instrument is usually a comprehensive bonded zone or bonded supervision site: goods can be stored under bond, distributed internationally and re-exported, and where conditions are met, metal ores can be physically blended.
The core value of such arrangements is deferring tax, freeing up working capital tied to inventory, moving the testing and selling window earlier, and allocating flexibly between domestic sale and re-export. One caveat deserves emphasis: bonded blending is not a way to “ship non-compliant cargo in first and sort it out later”, and it does not automatically change origin, tariff classification or responsibility for hazardous elements.
Since the Hainan Free Trade Port moved to closed customs operation, qualifying goods whose processing value-added reaches the prescribed proportion can enter the mainland across the “second line” free of import duty under the policy — but that policy requires the enterprise, the industry, the processing activity and the value-added ratio all to qualify at the same time. For most unprocessed run-of-mine material, or goods that have merely been repacked, the “30% value-added, duty-free” rule cannot simply be applied.
Six things to do before your first shipment to China
- Give the real product name, the mine location and the production process — do not let vague labels like “ore powder” or “high-grade ore” stand in for a product description.
- Provide a full elemental assay, moisture, particle size, mineral phases and the necessary radioactivity data — and allow the Chinese buyer to re-sample.
- Have the Chinese importer, a customs broker or a specialist pre-assess the HS code and regulatory conditions from the material and the documents; where it is contentious, consider applying for an advance ruling on classification.
- Confirm the port, the testing arrangements, the bonded facility and the end user before signing the shipping contract — do not ship first and look for a clearance route afterwards.
- Write solid-waste identification, return shipment, demurrage, quality deviation and hazardous-element exceedance into the contract as allocated responsibilities.
- Choose direct import, bonded storage or bonded blending based on your turnover and how firm the buyer is — not by reverse-engineering a route around a “policy benefit” that does not suit the cargo.
In closing: entering the Chinese market is not about policy shortcuts
China's non-ferrous market is large and its industrial chain complete, but the regulatory emphasis is shifting from “are the documents there” to “is the cargo genuine, is its classification accurate, is the risk controllable”. For overseas mines and traders, the most valuable preparation is not adding another intermediary — it is getting the goods, the testing, the classification, the port, the contract and the payment milestones right once, before shipment.
